USERS: Any person who accesses and/or uses ENEFECTO’s website shall be considered a USER, who, upon accessing and/or using this website, accepts the General Conditions of Use detailed herein. These Conditions shall be applied independently of the General Conditions of Contract, which must be complied with when accessing and using this website.
USE OF THE WEBSITE: ENEFECTO.ES provides access to a variety of information, services, programmes and data (hereinafter “the content”) on the Internet which belong to ENEFECTO or to its licensors and to which the USER may access. The USER assumes full responsibility for their use of this website. This responsibility includes registration where applicable to access certain services or content. During this registration, the USER shall be responsible for providing correct and lawful information. As a result of this registration, the USER may be provided with a password, for which they shall also be responsible, undertaking to make diligent and confidential use of it. The USER undertakes to make suitable use of the content and services (such as, for example, the chat service, discussion forums or news groups) which ENEFECTO offers through its website, including but not limited to not using the information to (i) participate in activities that are illicit, illegal or that are done contrary to good faith and public order; (ii) publish content or propaganda that is racist, xenophobic, pornographic, illegal, expresses approval of terrorism or that threatens human rights; (iii) provoke damages to the physical and digital systems of ENEFECTO, its providers or third parties, to introduce or spread digital viruses in the network or any other physical or digital system that may be susceptible to the aforementioned damages; and (iv) attempt to access and, if applicable, use the email accounts of other users and modify or manipulate their messages. ENEFECTO reserves the right to withdraw any comments or contributions that violate people’s right to dignity, whether discriminatory, xenophobic, racist, pornographic, threatening to minors or children, order or public safety or that, at ENEFECTO’s own judgement, are not suitable for publication. In any case, ENEFECTO shall not be responsible for the opinions shared by users in the forums, chats or other participation methods.
DATA PROTECTION: ENEFECTO complies with the directives of Organic Law 15/1999 of 13 December on the Protection of Personal Data, Royal Decree 1720/2007 of 21 December which approves the Regulation implementing the Organic Law, and all other current legislation, and undertakes to ensure the correct use and processing of users’ personal data. For this purpose, along with each form for gathering personal data, in the services which the user may request of ENEFECTO, it shall make known to the user the existence and acceptance of the particular conditions for processing their data in each case, informing them of the responsibility of the file created, the address of the data controller, the possibility of exercising their rights of access, rectification, erasure or opposition, the purpose of the processing and the data communications to third parties, if applicable. Likewise, ENEFECTO informs that it complies with Law 34/2002 of 11 July on Information Society Services and Electronic Commerce and it shall request the USER’s permission to process their data for commercial purposes.
INTELLECTUAL AND INDUSTRIAL PROPERTY: ENEFECTO either itself or as a licensee, is the owner of all of the intellectual and industrial property rights of its website, as well as of all items contained therein, including but not limited to images, sound, audio, video, software or texts, brands or logos, colour combinations, structure and design, choice of materials used, computer programmes necessary for its functioning, access and use, etc., or public links or projects undertaken by ENEFECTO which serve as examples of the company’s services, all of which is owned by ENEFECTO or its licensors. All rights reserved. By virtue of the provisions of Articles 8 and 32.1, paragraph two of the Intellectual Property Law, it is strictly prohibited to reproduce, distribute or publicly communicate, including the way in which it has been made available, either in whole or in part, the contents of this website for commercial purposes, on any format and by any technical means, without the authorisation of ENEFECTO. The USER undertakes to respect the intellectual and industrial property rights of ENEFECTO. The USER may view the items on the website and even print them, copy them and store them on the hard drive of their computer or on any other physical format provided that it is solely and exclusively for personal and private use. The USER must refrain from deleting, altering, avoiding or manipulating any protection device or security system that may be installed on ENEFECTO’s web pages..
EXCLUSION OF LIABILITY AND WARRANTIES: ENEFECTO. shall in no case be responsible for any kind of damages or losses that may occur, including but not limited to errors or omissions in the content, lack of availability of the website or the transmission of a virus or malicious software or illegal content, despite having adopted all necessary technological measures to avoid it.
MODIFICATIONS: ENEFECTO reserves the right to make, without prior notice, any modifications to its website that it considers appropriate, and may change, delete or add both the content and services that it provides through the website and the manner in which they are presented or found on the website.

In no case will ENEFECTO assume any responsibility for the content of any link that belongs to a third-party website, nor shall it guarantee the technical availability, validity and legality of any material or information contained on any of the hyperlinks or third-party websites. RIGHT OF EXCLUSION:ENEFECTO reserves the right to deny or withdraw access to the website and/or services without the need for prior notification, whether on its own initiative or at the request of a third party, to any users who breach these General Conditions of Use..
GENERAL CONSIDERATIONS: ENEFECTO shall pursue the breach of these conditions or any other unlawful use of the website, making use of all civil and legal action that corresponds to it by law.
MODIFICATION OF THESE CONDITIONS AND DURATION:ENEFECTO may modify at any moment the conditions detailed herein, and they shall be duly published in these conditions when they are made. The duration of these conditions shall be according to their exposure and shall remain in force until any modifications are made and duly published.
APPLICABLE LEGISLATION AND JURISDICTION: The relationship between ENEFECTO and the USER shall be governed by current Spanish legislation, and any dispute shall be submitted to the Courts of Spain.
